Oregon is one of those states where Americans often choose to move to escape heavy traffic, extended droughts, and sales taxes. It is in a beautiful region of the North American continent that also has moderate weather, majestic mountains and beautiful beaches – plus a thriving economy.

While similar to other states in having its fair share of crime and poverty, larger cities like Portland, Salem, Eugene, Medford and Bend have been able to maintain comparatively low levels of violent crimes involving assault, rape and murder. So far in 2014 Oregon ranks 39th among the 50 states in terms of total crime.

As is typical of other American states, crime rates tend to be higher in low-income and minority neighborhoods. Larger cities like Portland and Eugene have rates a bit higher than the state’s average but still well below typical national rates. Portland reports 517 cases of violent crime per 100,000 residents for 2014. Tennessee, a similar sized state geographically but about 50% more population, is ranked first for violent crime (behind the District of Columbia) with 644 violent crimes per 100,000 residents. Unfortunately for Jehovah’s Witnesses living in the area, criminal activity within their relatively small population has become an ongoing and growing embarrassment.

Former Jehovah’s Witnesses who lived or were raised in the area admit that a majority of congregations have been shamed by some form of criminal activity at various times over the past 30-40 years. (I’ve provided a group of links at the end of this article relating to some of the more famous and notorious cases that became public knowledge. My contacts within the state assure me that these reports represent just the tip of the proverbial iceberg.)

The most recent case comes out of the community of Hillsboro, a suburban city located about 20 miles west of Portland. On December 1, attorneys for Velicia Alston, 39, joined her in a news conference announcing a lawsuit filed against the Watch Tower Society.

She and another plaintiff are asking for $10.5 million from the Watchtower and her childhood congregation for abuse they suffered from a fellow Jehovah’s Witness when she was still a pre-teen in 1986-87.

Ms. Alston’s lawsuit names Daniel Castellanos as the abuser, but also points much of the blame directly at her local Kingdom Hall’s elders. Why? Because they knew about the threat Castellanos was to children in the congregation, but chose to take no action to protect her or his other victims. Her fellow plaintiff was reported to be only 8-10 years old when he suffered abuse from Castellanos.

Irwin Zalkin, an attorney based in San Diego, California has joined with a team of lawyers who will prepare and present the case to the courts on Ms. Alston’s behalf. Zalkin comes off a recent $13.5 million lawsuit filed against the Watchtower for similar crimes committed by a Jehovah’s Witness in Southern California.

Zalkin and Miss Alston appeared during a press conference announcing the lawsuit. Portions of that press conference are available here and were aired on local television stations.

While Zalkin and his law firm have been very successful in past cases resulting in dozens of settlements, he faces some unique challenges in Oregon courts. Oregon has some contradictory laws that apply specifically to religious organizations.

[UPDATE: Mr. Zalkin clarified the situation in this case. The Oregon confidential communications law described below WILL NOT apply in Ms. Alston’s case. All JW elders and other witnesses in this case have provided pertinent testimony and have not invoked “clerical privilege.”]

Oregon law requires members of the clergy, like teachers and social workers, to report any allegation of child abuse to the police. Another law (ORS 40.260) provides an exception if it is part of a church’s religious practice to keep confidential communications secret between clergy and members.

How does this law apply in real situations involving an admission of child abuse?

While I am not an attorney, the statutes involved are pretty clear. Basically, if a member of the clergy (including JW elders and ministerial servants) suspect that a crime is being committed or get reports of a crime (especially child abuse), they must notify the police about those reports as any other social worker would have to do or any citizen should.

However, if the perpetrator of those crimes against children comes to the local elders or ministerial servants and asks for help or counseling – or even just admits to committing a crime – another law (ORS 40.260 – see reference below) specifically requires silence on the part of the clergy. (Again, please note that this is my unqualified interpretation of the law.)

As a further example of how I think these laws might apply, allow me to offer the following illustration:

A Jehovah’s Witness elder is a witness to a crime being committed – or gets a report that a child has been abused and has been admitted to a hospital. He knows the child and the parents and realizes that something must be done. Like any other citizen, social worker, or medical specialist, he is supposed to report the incident to the police or appropriate authorities. But if he learns of the crime because the perpetrator came to him and admits to his or her involvement, the elder – by law – must not and cannot report that information to the police.

Zalkin and his team are very experienced and successful in handling these issues. Miss Alston has a winning team working for her and her co-plaintiff. Unfortunately for Jehovah’s Witnesses in living in Oregon and for the Watch Tower Society’s leadership in New York, no matter how the case is resolved it will become another scar on their public face and reputation. We expect that this story will be well reported by Oregon’s press and TV stations.

    I wish that we could file lawsuits so against the WT Society for the physical abuse we endured as children. Remember that stupid song that had the line, “God says use the rod”?!? WTF?!? The problems that I’ve had to endure in my life from beatings from my parents who were convinced that they were doing what Jehovah thought was right (beating the hell out of their kids), missing all of the sports, holidays, birthday parties for ourselves and our potential friends (I remember sheepishly returning invitations because God hated these parties and the worldly kids who wanted to be friends), and the humiliating and time-wasting door-to-door ministry that has to Biblical backing (as if the Bible is some kind of divine message from God anyways).
    There has to be a way to put together some kind of legal case against this evil Organization that stole our youth, opportunities and possibilities!

    I’m an exJW, the son, grandson and nephew of elders, and I can say from direct experience that this is far more common than most people know. This isn’t even the most harmful policy they have handed down. There are many good and well-intentioned witnesses, but whether evil or incompetent, those in charge are deaf to the cries of suffering they’ve caused.

    Im not familiar with the reason why it is taking in some cases over 20 years, for these cases to see a court hearing, can some one briefly explain why these victims are being prevented from suing closer to the time of the crime? many of these seem to have happened in the 80s, its 2014, and its just now coming out. this seems crazy to me. Is it because of the fact they were children, so fearful, and have to wait till they are adults with some money to hire an attorney? It seems so unbelievable to me that a parent could find out their child was molested and not absolutely loose it!

    I am so glad this is finally coming out into the open for people to see just how sick and disgusting this cult is. I have lost family and friends from the doctrines they teach. They are not of GOD…they are a demonic family destroying cult sucking life from everyone in it. Though those still in refuse to see the truth even when faced with overwhelming proof of the wrongs against children. It saddens me that they continue to pull the wool over the unsuspecting with their love bombing and display of pretty pictures to coerce people into their ‘society’. I agree with JJ above…I too wish I was able to bring a lawsuit against them for the abuse suffered as a child. I am now 58 and the emotional scars though not as severe as those who were raped as children…are still there. I have no peace in my mind from this demon cult. My only hope is for those who are studying to research this cult so they can see exactly what they are in for. And those still in to see the truth that is staring them in the face and leave before they face God and see just how deeply they are involved with demons!

    @JJ I totally agree with your sentiments. All states have truth in advertising laws, requiring businesses to honor their promises or face stiff penalties. The JW brand of religion gained their growth and financial advantages by outright lies to the public with promises of paradise before the end of a generation. Their definitions of what that meant were clearly defined by the leaders. As self appointed leaders they went one step further than any retail store could ever do. They threatened the peace of families and their followers for not supporting these lies and did not allow any JW to check the facts under an expulsion rule.

    Simply stated, in the United States the traveling snake oil salesman promising the fountain of youth has long since been exposed and legally stopped. However religions such as JWs that have sought to cut into the following of the Catholic Church that they clearly targeted, stopped at nothing to attract followers and resorted evils to keep them. This in my opinion is worthy of a case for all of us. We are all victims of WT theft and misrepresentation, although clearly not to the same degree as those victimized by these horrible crimes.

    In all 50 states it is illegal and a criminal matter to write a check (A check by definition is a promise to pay) and not have sufficient funds to cover the amount written. All of the false promises made by Watchtower and the huge cover up by excommunication is nothing short of criminal. However specific laws need to be drafted to stop them. These laws come from petitions and voters. Watchtower has underestimated the power of the internet and its ability to unite former Jehovah’s Witnesses into a community. Hopefully soon we will have sufficient numbers to gain the attention of law makers so that we may receive restitution for what was wrongfully taken from us and our families.

    Thanks for the very good article. I am truly saddened for all the people that put their trust in this organization. I read a lot of the references you provided (thank you) and cannot believe how many people were known abusers and yet were elders, Presiding Overseers and received only private reproof in some cases.

    If they believe in the ideal of an all knowing God, why is he asleep when it comes to the one organization with his name on it? Why are they not a shining beacon of what is right? Wasn’t Daniel placed in a lions den for his unwavering adherence to what is right and his loyalty to his righteous God? Why would the JWs worry about any legal backlash that could come from a known child molester as a result of making his crimes public knowledge. In fact states have a registry making their names public. Why wouldn’t an Almighty God require the same to keep his littlest servants safe?

    Excellent comments from the Ladies on this site.WOMEN seem to be the target of the watchtower.They are the ones who are Pioneers and do the bulk of the preaching work.They have primary responsibility to teach their own children while husbands are working .They prey on people usually when they are in a weakened emotional state & people yearn for a better life & will believe anything when they are love bombed!!Most people don’t do their research properly before baptism & later it is hard to admit they were duped!!

I kid you not, we have publishers that won’t speak to someone who can’t pay them back the $500 they loaned to them but will buy a round of beer for the pedophile they know.

    If you have kids pleaz make sure they go to college, know the truth about the holidays and live life instead of cowering in fear like we did. Nothing will return all your lost time as a child but think about how Ray Franz was 65 years old without a penny. What about the Gilead Bible Conductor(Dunlap) and other “Aid” writer all were kicked out penniless in their old age by a evil cult. We need to change the law so Bethelites get paid if they are kicked out after twenty or thirty years, that’s a fight worth fighting too!

    It is a very hard thing to press charges for the victims of child abuse. There are many valid reasons for that. It is something that is not solely involving JWs. Child abuse victims often cannot, for very valid reasons, start proceedings soon after the abuse has happened.

    I’m so sorry to read about your comtinuing pain caused by this cruel cult. I can relate to how you are feeling. It may be beneficial to contemplate the possibility that this cult is solely and exclusively run and created by a group of men, human beings with no influence by demons.

    I may be wrong. Perhaps there are demons. However, we can all agree that it is these men that we need to tackle if we want to make things better for others.

    If these wicked demons are running things, then there is comfort to be found in the scriptures. I would encourage you to remember that Jesus Christ will never forsake you. He will never leave you and He loves you.

    But before all other comfort and advise, I would urge you to seek professional help for your problems. I did, and still would if I needed to.

    Your feelings are reasonable and are normal. We were all raised to believe lies as truth, and we have all been abandoned, to a greater or lesser degree, by our loved ones and friends. It’s natural that we will be hurt and angry and feel deep sorrow.

    But we are never alone. For those of you with Faith, there is your God to comfort you. For all of us there is professional help if we need it. For all of us there is a growing, nebulous and amazing community of ex JWs on the Internet where we can find ones who understand what we have gone though.

    Have you spoken to Mr Zalkin about a class action? I have no idea if your idea could fly legally, but it is certainly worth emailing the Zalkin Law Firm, and getting some advice on this.

    If such an action were possible, I think it would have a better chance of success in the USA, rather than here in Europe.

    @ Sharon Lee Murray: Perhaps the best approach is to rise above all the negativity showered over us when we were kids (I am 58, too, and an ex-Bethelite)

    Discover Your skills and focus on developing on them, even, at a late age. Pull ourselves out of the “Treacle” of self-despair and pity that Watchtower bogs us down with.

    Shine! and, show them, you can stand with head high without them. Overcome the Evil with the good. Smile, and hit back at their hatred with love. Watch the old Wizard of Oz shrivel behind his makeshift curtain!

    I hope that the victims in this case receive the justice they deserve and that the disgusting men who abused them are prosecuted to the full extent of the law.

    This raises controversial issues. When does religious belief have to be subject to secular law? Should a law be able to silence a Minister who may want to report a crime?

    I believe that no religion has the right to withhold details of a crime that it is aware of from the authorities.

    @JJ. I wished I could say that I wasn’t guilty of using the “rod” but I was one of those parents. I loved my kids so much but my husband convinced me that it was the “loving” thing to do to use a wooden spoon to discipline them. It got so bad that when my youngest was in 5th grade, a teacher saw marks on his legs because of using a belt, and the state took my kids away for a week (my youngest daughter says 2 weeks) but it was the best thing that ever happened to me and my kids. Up to that point, they hated me but I didn’t know what else to do since it was my husband who was insisting I use the wooden spoon on them when they misbehaved. When the state stepped in, I had to sign papers that I would never touch them again or they’d take the kids away permanently and then it was that I had to find a different way to “teach” them. I am so glad that this happened to me because I had time to turn things around with my kids and today they don’t hate me but they sure remember the abuse.

    This religion turns “normal” thinking into something that goes completely against normal in the name of following what “God” wants them to do.

    I served in Bethel and my wife and I spent 20 years total of “full time service” We were cheated and do deserve restitution as do so many others for WT’s lies and deceptions, more importantly false promises. In every other area of life such crimes are actionable in court.

    Religion has long been a means that government has used to control the masses. However we are talking about a religion that provides nothing to the needy, that does not provide protection to any of their citizens and sends many of their citizens into poverty.

    I spent 16 years in finance and dealt with a large amount of Jehovah’s Witnesses. The vast majority of them have received government assistance, suffered from terrible credit scores and very often bankruptcy as well as an inordinately high number of them have no health insurance. What do you think the tab that the JW religion has run up with the government looks like?

    One may argue that JWs do janitorial work and other menial tasks without complaint, so they serve a purpose in society. However look outside the JW faith and you will find a lot of people that do the same jobs and work for companies that provide these benefits rather than considering themselves business men and women. The fact is most are taking advantage of their governments free aid and the Hippocratic Oath of doctors. The JW lies cost more than just JWs, it costs society as a whole. These liars need to be exposed and stripped of their wealth so this stops.

    The hurt goes beyond Bethel to all JWs who have missing teeth, no savings, little to no life insurance to protect their families. I understand the comment about Ray Franz, but see no need to offer him any more consideration than any other JW. I have seen the financial devastation that is caused by JWs pushing the local congregations not to work overtime and instead preach, that the end is coming so why would anyone be saving for retirement. The guilt trip placed on everyone to contribute from an already reduced income due to lack of education and little to no overtime.

    Final thought. Bethelites may come out penniless and broke, however that is far better than being penniless and strapped with debt that you will never pay back and that is what I have witnessed, literally for hundreds of JWs. Think of the victims of abuse, no doubt some are penniless broke and a victim not just of lies and excommunication, but of sexual abuse!

    I will gladly sign a petition for laws required to stop WT lies and abuse, or join any class action formed to do the same. I make this promise, any monies that I would receive will go to 2 charities, one being a medical charity and the other for victims of abuse. I will put it in writing.

      @Tiger: how do we facilitate change and force the Watchtower to provide some annuity or pension for long-term workers removed from their positions because of corporate cost-cutting? There are lawsuits against Scientology asking the Government to compensate Company workers and give they their due. Something needs to change, why should the Tax Payer(glad there are provisions to protect the poor because I would rather see money spent on people than the Military Industrial Complex.) be responsible for the Watchtower putting good people in perpetual poverty and totally dependent on them for financial well being in their old-age?

      I think maybe we can be a “friend of the court” who sees their outcome. How can we change the law that makes fake non-profit corps like the Watchtower pay for retirement benefits long-term Bethelites and Full-time Missionaries deserve?

    @tiger123, I echo your sentiments exactly. I feel we have all been abused and used in one way or another. I watched the new “show” from Watchtower for December and was completely disgusted by the part where they were begging for more money and how they were showing that no matter how poor your are, you are expected to put money in the contribution box and yet all that family had to eat was plain rice!!! And then it went on to show a new branch in Germany where you could tell it must have cost poor Witnesses millions and millions of dollars to build and was nothing but luxurious opulence. One of Jesus’ illustrations was about the man who kept building bigger and bigger storehouses and for what??? That is all the Society does and they keep asking for more and more money and for what???? I look at the expensive suits and rings on their (Governing Body) fingers and all I can see is donations from poor people who have nothing to eat except plain rice going to pay for their expensive suits and cars and I am sure these men don’t have to worry about health insurance. They are the worst of hypocrites and I have zero respect for them.

    I think it is a fair comment to say that the majority of Jehovah’s witnesses have suffered from some sort of abuse.
    Though many of us, thankfully, have not suffered from sexual abuse we have suffered from emotional, intellectual, spiritual and financial abuse.

    In their latest video a single mother with children are portrayed as poor by eating rice.
    The Watchtower did not state “hey, help these poor families”. The message, loud and clear, was, “help us instead with your monetary donations”
    Take a look at their plush tv studio, their Bethels. Look at where their living, eating and having everything done for them.
    No worries lads, ” you’ll always have the poor with you” eh?

    @gary, they made it loud and clear that if you are a poor widow, you will not be getting any help from the Society. In the video, they tried to make it look like this poor mother was getting help only by the elders coming by and sharing some scriptures with her. Nothing said about helping her out any other way, but she was supposed to be giving them money instead!!!! Then look around at the rest of the show and see how plush it is for all of them. Even if I hadn’t been awakened up yet and watched that video, I would have been utterly disgusted by it.

    I noticed on one of the Oregon News articles the commentary was full of arguments, one of the posters was obviously a paid WT agent. It amazed me how this person stooped so low as to bring Ms Alston’s private life up to show her as an immoral woman in their argument. If I wasn’t already stumbled, that would have stumbled me. I was so disgusted & angry when I read their comments. That they could use this against her. She was a child for God’s sake when she was abused!!

    The other argument this person used was that Zalkin Law firm were seizing an opportunity to suck money out of God’s Org, the WT. Well Hallelujah!!! I pray & support Jehovah, Yahweh, Jesus or God whomever you are to use this Law firm to bring down this awful cult that dares to use His Name in a worthless way.

    We need to petition our State and Federal Governments, plead our cause before congress. Make a strong plea for reform of religious organizations that hide behind legal shields and can say and do anything they please along is it is under the umbrella of religion.

    The case is simple:
    1. Shunning is a violation of our human rights. Isolating a person from their families and only friends is a form of cruel punishment. The New York Times reported on this in an article called “Cruel Isolation” Published: August 1, 2011 these tactics are used in maximum security prisons as “a dehumanizing form of punishment well known to induce suffering and drive people into mental illness”
    2. Making false promises and guarantees to adherents while not allowing any of their prophetic doctrine interpretation to be questioned is a violation of public trust. Using dehumanizing tactics to force them into servitude is an abomination that must be stopped.

    3. When a person becomes a JW and finds out the truth about the religion they are faced with an awful prospect lose everyone they know and love and face the world alone with no education, no contacts and face emotional and very often financial hardship and ruin.

    The process is simple. Create petitions to request lawmakers to regulate religions that bring emotional, financial and social ruin to their followers as a direct result of their lies and inhumane policies. Once the laws are created, use those laws to seek damages from Watchtower for their violations of those laws.

    It is important to note that such laws are not really new, the only element of such laws that are new is that the laws that exist be broaden to include religious practices that violate human rights and require they not barter lies for the services of their adherents.

    I dont know where you live, so might not be aware of some of the celeb cases that have been happening here in the uk. These kids were kept quiet by the fear of not being believed, or just simply because wthey looked up to and admired their abuser. Yes as they became adults the immenisty of it all may have hit them, but still they felt no-one would believe them. I think Candace Conti set an enormous ball rolling and many have seen they will be believed. As a victim of abuse for seven years within my family ( not while I was in the truth) it took me untill I was 40 years old to finaly tell my mother.

    Some seem astounded that how can INTELLIGENT WITNESSES still follow Governing Body and stay in the Truth after all these factual& documented Abuse cases show that Jehovah cannot be backing an organisation that doesnt inform congregation members when known paedophiles are in the congregation.Many have invested & sacrificed so much time& energy& money that it is frightening to admit they Have been CONNED BIG TIME.But look at Dictators of the past who have murdered millions such as Stalin,Hitler& Mao tse Tung in China.Many cried their eyes out when they died& some in these countries still yearn & worship these evil cruel tyrant.Very Very Sad!!!

    @Chatpal, Sexual abuse is a traumatic experience, and leaves the
    victim with a feeling of being degraded, And as with many bad
    incidents in our life we prefer to shut them out of our mind and forget
    they ever happened. But this is not a solution, the thoughts are still
    there, dormant, but re-surface sometimes to cause us grief.

    When other victims courageously go public and reveal their experiences,
    they realise that this is the way to rid themselves of the emotional burden
    they’ve carried for years, as well as being the “Right” thing to do.

    ball rolling”.

    All of THE ABOVE COMMENTS are TRUE from everyone of you .Anyone who reads these heartfelt stories can FEEL YOUR EMOTIONAL PAIN & HEARTBREAKING LOSS of Time,Energy,Money& Lost opportunities&maybe Division of Family Members .I have been Baptised over 30 years but am working on the inside secretly getting as much info as possible but using LOVE & Subtlety in trying to get ones to occasionally using logic in comments in the watchtower & at family gatherings to show up the Craziness of the Governing Body!!! Some are BLANKING me & some are not sure as I mix my comments with mock support for the organisation.But some will just turn their backs on me because of one comment I made in watchtower which I said ‘I hope the F&D Slave get the Generation Teaching right this time as I have lived through 5 different ADJUSTMENTS’!!!Boy you could hear a Pin Drop!!! I want to see how far i can take this Theocratic Warfare.I have love ones still in who I am trying to save!Wish me well in this Cat&Mouse game!!

    History has shown battles are one by attacking a enemy on more than one front.To be successful many armies will send spies behind the Lines to get inside information to influence & weaken the enemy.We need more JWs willing to take the fight & break the organisation from within…an attack from where they least expect it.DOUBLE AGENTS who appear loyal but craftily& gently by befriending ones & then dropping subtle comments.I think one Elder has suspicions but not quite sure about me.!!! If I am pulled into backroom for a chat with Elders just look tearful and oh so sorry!! But I am determined to save as many of my loved ones this way by keeping lines of communication open with as many as possible.I wasn’t bought up in the truth & was well educated at Private school and had a good job before I got the Truth & pioneered.Loved Spy Novels like those by John Le Carre. I have done my research properly.There are no GREEK WORDS for Governing Body in the Greek Scriptures .We have been sold a lie.Into Battle we go to save as many as possible!!
