The Society has suffered another setback in the Conti case that will increase the financial strain on the organization

The Watchtower’s proposed use of Patterson to provide security for the damages award in the Conti case has been thrown out by Judge Robert McGuinness in a stunning setback for the Society, who were hoping to get out of paying a costly annual premium on their $17 million bond – or get the bond reduced altogether. Their failure to get the motion passed increases the financial strain on the Society, making it difficult for them to try to prolong the appeals process.

In presenting their motion, the Society argued that it was in Candace Conti’s interests to accept Patterson as security rather than force them to pay the court-imposed bond using a Travelers surety bond. Travelers is an insurance company that allows defendants to effectively pay large bonds without paying all the cash out at once. Rather, the defendant (in this case, the Watch Tower Society) must pay large annual premiums to Travelers, creating a considerable financial burden. Obviously, the Watch Tower Society only has funds donated for the Worldwide Work with which to make these payments.

To illustrate, think of insuring a car. You must pay an insurance company a fixed sum of money annually (or in monthly installments) so that, if you have an accident, your insurance company will be able pay a much larger sum of money on your behalf to cover any damages. It works similarly with a Travelers surety bond. The Watch Tower Society pays Travelers an annual premium, and in return, Travelers guarantees that the bond is effectively paid as far as the court is concerned without any actual cash changing hands (similar to an “IOU”). The only difference is that, if Watchtower loses their appeal, Travelers will have to make the payment of damages on their behalf – but Watchtower will still be liable for settling this amount with their insurer. The surety bond with Travelers is really just a means for Watchtower to keep hold of the money until it becomes absolutely necessary to pay it if the appeal is lost.

Watchtower’s lawyers tried arguing that, if Candace lost the appeal, she would have to repay the annual bond premium payments to the Society in excess of $80,000 per year for however many years the case dragged on.

Though feigning interest in Candace’s future well-being, it seems this motion was really just a clever ploy to try and drag out the appeals process by reducing the financial drain on the Society’s resources during the lawsuit. By offering Patterson as security rather than setting up an expensive surety bond through Travelers, the Society could have bypassed the need to pay a bond premium – effectively “buying some time”, knowing that however long the case dragged on they wouldn’t have to pay anything apart from their own legal costs.

In the worst case scenario, if the Watchtower lost they could have simply paid the final damages award instead of handing over Patterson, but without the expense of year after year of costly bond premium payments during the course of the appeal. This plan has fallen flat on its face, thanks largely to the fact that the motion was inherently flawed and couldn’t have been accepted by the Judge even if he felt so inclined.

A flawed motion

In trying to get their motion passed, the Society tried arguing that there is no legal reason why property cannot be offered instead of paying the full bond through a Travelers surety bond. Watchtower admitted that nowhere in Californian Law does it specify that property can be used in this way, but they argued that the Law doesn’t expressly forbid the use of property as surety for judgments either.

Rick Simons pulled apart this reasoning ruthlessly in his opposition to the motion, saying:

“The Church Defendants recognize that the controlling statutes ‘do not specifically mention the use of real property as collateral for a deposit in lieu of a bond…’ (Church MPA 5:5-6.) However, the argument continues, the statutes ‘do not expressly forbid its use, either” (lbid.) The Church Defendants’ argument ignores the well-established principle of statutory construction, fondly known as ‘expressio unius est exclusio alterius.’ Simply put, where exceptions to a general rule are specified by a statute, other exceptions are not to be implied or presumed.” (page 2, Memorandum of Points and Authorities in Opposition to Motion to Substitute or Reduce Bond on Appeal)

It seems that, when filing their motion, Watchtower’s legal team over-looked (or were unaware of) basic legal principles that rendered their arguments meaningless. It seems fairly obvious that if a list of acceptable ways of paying something is presented, you shouldn’t try adding to that list merely because your preferred way of paying isn’t clearly forbidden. Imagine getting your electricity bill through the post, and calling your supplier to offer to pay it in jewelry! The very idea seems ludicrous, but this is similar to what Watchtower has tried to do with their motion – and the attempt has failed abysmally.

Watchtower also requested that if they couldn’t be allowed to use property as surety they should at least have the bond amount reduced. This part of the motion also failed, because the court doesn’t have the power to reduce the bond amount below the amount that is required by the relevant statute. It seems that in both instances, Watchtower’s legal team has failed to research their ideas properly or ensure that the Judge could legally uphold their arguments. This will surely be music to the ears of Candace Conti and her legal team as they brace themselves for the appeals process to get underway. If the Watchtower can make such amateurish mistakes in filing this motion, what are their chances of successfully getting the verdict overturned on appeal?

One thing’s for sure – the Watchtower’s lawyers will have to raise their game and do much better if they can have any hope of overturning this verdict. Now that they have had this motion denied, the clock is ticking – and every day that the case drags on will cost the Society huge amounts of money in premium expenses. They have effectively had their “comfort zone” removed, and any incentive to try to drag this appeals process out has vanished. This case will need to be resolved quickly, one way or the other, because the costs will only accumulate the longer this continues.

How the Society must wish that they could settle with Candace! However, as she has stated clearly from the beginning, her aim seems to be to see this through to the bitter end and record a damning judgment against the Society rather than let this slip away quietly.

Some awkward questions

The Candace Conti case has thrown up so many uncomfortable questions that thinking Witnesses will need to ask themselves. Not only has the Society been found guilty in a court of law for its mishandling of child abuse – it has also failed to use the opportunity to implement urgently needed reforms that would serve to genuinely protect the children of Jehovah’s Witnesses in the future. And by trying to offer Patterson as surety in a court case, the Society demonstrated a willingness to expose a dedicated and renowned Bethel facility of Jehovah’s Witnesses, built by volunteers and paid for with donated funds, to potential risk if the appeals process had been lost and the funds to pay the damages could not be found.

Finally, whether the appeals process is won or lost, money that has been donated by the brothers for the advancement of kingdom interests will be regularly leaving the bank account of the Watch Tower Society to pay for their legal obligations in a case involving the mishandling of child abuse. Even if the Society wins their appeal and the money is somehow repaid, thinking Witnesses all over the world will feel significant unease that they are giving money to the Society that is not being spent on the preaching work, but rather on bailing out an organization, supposedly directed by Christ, for its negligence over child abuse.

    Here’s an interesting thought…We’re always reading the prophecy of the ‘last days’ at Matt chapter 24:42-51, which uses the term ‘evil slave’ BUT, if you go to Luke chapter 12: 42-48 and read the parallel account, notice that Luke just says ‘slave’ [overseer, or manager] The WTS has always applied this to christendom or apostates, but in verse 44 of Luke, notice that the “Master’ appoints the slave over his ‘belongings’ [or household]. So, how can this apply to christendom or apostates of earlier days? It has to apply now to the organization. Then AFTER that appointment he leaves to prepare for the wedding feast, [Please read also the appendix 5D in the back of the NWT reference bible] and that is when the slave starts to beat the others in the household. Now, in vs 54-59 especially vs 57-59, which are not mentioned by Matt at all, and this is the reason we never read Luke’s account, Jesus gives an example, because they are not settling matters in a RIGHTEOUS way they are being taken to court and ‘will pay over the last coin of very little value.” [New World translation]
    Take it for what its worth, but its very sad the organization that claims to represent Jehovah God & Jesus Christ, has allowed themselves to bring such a gross reproach.

    In the past, the society has always been able to settle any child sexual abuse cases out of court. Although they have apparantly paid out millions of dollars to victims in the past, at least they were able to hush the whole thing up, and more importantly for them not risk losing the case in court which could then have set a precadent for other cases that might well come up in the future. Because this time the victim has not caved in to the Watchtower, and accepted a cash settlement out of court, the Watchtower society is not only attracting bad press around the globe, but also will have to pay out millions of dollars in damages, and worse for them, it will open up the floodgates for other abuse victims to take them to court.

    The Jehovah’s Witnesses require ‘two witnesses’ to a crime or it didn’t happen,you are supposed to ‘leave it in Jehovah’s hands’ wait on the lord.
    How many pedophiles allow an eyewitness? These people engage in a door to door ministry, possibly exposing children to pedophiles.
    The Watchtower corporation has paid out millions in settlement money already.

    Every time the WTS makes a payment for anything legally related to anything other than the preaching of the Good News it is illegitimate. What has this issue to do with the preaching work?

    Every time a publisher puts money (including children from their pocket money) into the coffers they make the reasonable assumption that it is to further God’s Will, not fund bad theology.

    Perhaps we will see a ‘Berlin Wall’ moment here .

Please, Watchtower change your policy and help protect children from abuse in the future.

      I happen to know that two whistleblowers, the Andersons, a couple who were working in Brooklyn Bethel had stumbled across the figure. It was reported when I read about it in 2002 that the figure was for the English-speaking world at the time.

    Thanks for the article- but because of the tone I suspect a point is being missed about the capabilities of the WT legal team.

    Lawyers use arguments -good or not to see what the judge will allow. The WTS lawyers are not necessarily bad or stupid because they lost this round.

    Supposing that the WTS is going to loose in horrific way with a complete financial meltdown isn’t realistic. We are not privy to their end game strategy or why their lawyers have pursued this course. It would be reasonable to suppose that delaying a settlement suits their purpose.

    It is also worthwhile to note that recently that the WTS changed their child abuse policy- I suspect this ”new light” was carefully crafted by their legal team.

    Rather than viewing this legal proceeding as a
    triumph of good v evil it might be prudent to realize that court case outcomes rarely have anything to do with justice. The machinations of the California Court System do not right intrinsic wrongs. Instead the Conti case through media coverage and financial sanctions brings pressure on the WTS to change.

    Fair play to Candace Conti for bringing this case forward. To have to testify about the violation of innocence cannot be easy- a brave choice. And having the clarity of purpose of NOT taking a settlement tied to a nondisclosure agreement is ethical, moral and just plain righteous- kudos.

      Thanks for your considered analysis Daphne. I’ve heard others suggesting that the Watchtower lawyers took a calculated gamble and knew exactly what they were doing. I’m not convinced. The way I see it, if they’re weren’t stupid in trying to get the motion passed then at the very least they underestimated Rick Simons’ abilities to expose the flaws in their motion and/or the Judge’s ability to impose statute in his decision-making. Underestimating your opponent is never a productive approach in any battle, let alone a legal one.

    Hi Daphne. I find your tone to be very balanced and honest.

    I wonder, though, in what way you think the WTS has ‘changed its policy’? I’ve read the “new light” letter (it is not being promoted as ‘new light’) and all I can see is the shifting of responsibility. My own theory is that headquarters wishes each country to fight its own battles and leave Warwick out of it. Each country has its own laws (like Australia and the Steven Unthank government submission) and I think the WTS wishes to be kept out of future legal problems. This, of course, doesn’t mean they don’t wish to be informed.

    As to ‘justice,’ I think the Contis wish only to bring the issue of secretive decisions when it comes to congregation criminal activity to light. You are right; secular courts are concerned only with enacting the law, whether anyone believes it to be justice or not. What is at stake here, though, is that the children of Jehovah’s Witnesses, like ANY OTHER CHILD CITIZEN deserves the full protection of Western law. Secular law isn’t perfect but it is 2000 years ahead of the present religious child protection of this organisation.

And to CandaceI say…”RIGHT ON CHICA!” I am a mother with two children now but I too was a victim of abuse at the hands of a servant in the Kingdom Hall of JW’s. I am so glad you are doing this Candace. You’ve no idea how much I’m rooting for you kiddo! I am sending huge hugs your way and love from my family!

    Yes I believe there are many ways to look at the WTS lawyers and the work they are doing on the Conti case. I watched a video interview with Simons and he seemed to think that the other lawyers were out of touch with the horrific realities of the Conti case and how it is perceived by the jury and the public at large. They didn’t understand that molestation is not acceptable. At all.

    My take on the WTS lawyers is just another facet to consider. I would hate to have hopes to be built up because of hyperbole and then have them dashed because the WTS does not suffer a resounding, well deserved defeat.

    My personal opinion is that the WTS has spilled gallons of ink hypocritically writing condemnations of the Catholic Church for child abuse. For years it seemed like there was some sort of mention of the scandal from the platform or by way of comments. I think it would be appropriate if every rank and file member knew about JW abuse and knew as a certainty how their org is NO different than the Catholic Church. I would love to see this bit of Karma at my local Kingdom Hall.

    While my family may not agree with this case as they are all JW’s they will all likely support their faith. The view that this is an organization run by imperfect people but divinely inspired by God is in my view delusional. Corruption in any establishment is just that very idea we all cringe at when considering those that blindly ignore it with the facts available to all. I can confidently inform you all that if you believe in Jehovah God as the Supreme Creator of the Universe then he left this group as soon as they covered up evil deeds done by fellow members. Jehovah does have a history of removing his enemies and this also includes an organization claiming to be doing his will on Earth in his name. A true believer will see through it all and as I was once a member I do not trust this organization anymore. The truth is what JW’s call their faith but when confronted with the truth of this case you must personally evaluate whether supporting their actions by not protesting these policies should be on all members minds. I would hate to see this covered over and would truly believe they have lost Jehovah’s protection and love if a full scale reform is not made immediately. Thanks all and my love to all those victims that are silently hurting from those protected under this policy.

    Thankyou Cedars for this updated article on the Candace Conti case.
    Really pleased to hear that the WTS did not ‘blind’ the judge to their way of thinking.
    JWs will no doubt be told this is an attack by satan on God’s organisation. But much of this could have been avoided if they followed Jesus’s example. Sticking to one rule (two witness rule)
    while ignoring hundreds of other rules set out by Jesus in the bible. Does not make good sense!
    The WTS grossly neglected the golden rule in the bible, namely,
    do onto others how you yourself wish to treated. Hence, Love your
    neighbour.

    The Watchtower should make it clear that children matter to them.
    Every child that gives evidence of sexual abuse and names their abuser should be handed over to the Police to investigate.

    One witness, the child is enough.[ For the benefit of the child.]
    Child predators find the Elders a walk in the park. It is a different matter with the Police.

    This should be publicly announced to all at their meetings, the child predators will soon disappear and move on. The longer Elders handle these matters, the children suffer. And the predators hang around.

    You can not handle a child predator with kid gloves. If any child abusers have been appointed to positions of overseas, then it would be wise to undo these appointments quickly.

    So, Upset, are you saying “the slave” is fulfilling biblical prophecy in beating its fellow servants of the household?

    For years, we’ve felt we had to cling to the Watchtower & Co., by defending its practices as Jehovah’s Witnesses and its administrative influence over Jehovah’s Witnesses. The line of separation is certainly blurred in the USA where the body of Jehovah’s Witnesses ends and where the legal entity and so-called publishing arm begins. Authoritative appointments and “deletions” are all written on Watchtower corporate letterhead; CO’s and DO’s roam using Watchtower expense accounts.

    We feel guilty for making the Watchtower earn its respect, because that would be “fighting God’s anointed.” Its always been this way, but these scandals bring to the fore and daylight that the Watchtower and its JW hierarchy of leadership MUST prove they’re capable and worthy of being followed. The fragile staff of authority–1914 AD–no longer cuts the mustard, as the saying goes. Too much “evil” has transpired under this “fasces” and we can no longer be quiet and let our children and family be subjects of this evil.

    Vote with your dollars. Withhold from the Society. Donate to a worthwhile local charity group, instead.

    I agree, it is sad. I keep saying that to the elders when I do see them from time to time, that you are not paying attention to the warning about the slave becoming evil and beating the fellow slaves. If you ask me it seems they have the trademark and behavior typical of the high ranking Jesuits…I do not understand how they would not deal with the pedo’s swiftly and harshly and openly let people know. That would be the correct responce,not a cover up. Because cover ups do not last forever, little Toto will gently swing back the curtain and people will find out. It seems only fellow Pedo’s protect pedo’s . Me?? If I had children and that happened, I would give the pedo a thrashing of just short of his life in front of everyone, and let everyone know thats what happens to you if you rape of fondle children in my presence and try to get away with it through stupid policies such as this .

    You know, this policy thing is exactly what the goverment has been doing to the constitution, add unconstitutional policies masked as laws…hence the word POLICE,instead of peace officers to keep the peace… as they are there more to enforce policies than the law. The elders have become much like the police to enforce the governing body’s unbilical policies on the flock.
